Terms of Service

1. Provider And Scope

5050 Studio is operated by Daniel Meier, Eckersmühlener Hauptstr. 115, 91154 Roth, Germany. Contact: support [at] 5050studio [dot] com. Additional provider information is available in the Imprint.

These Terms govern access to and use of 5050 Studio, a software-as-a-service platform for creating, processing, managing, publishing, and reusing AI-assisted creative assets, prompts, workflows, and related media.

If you use 5050 Studio on behalf of a company, agency, or other organization, you confirm that you are authorized to accept these Terms for that organization.

2. Eligibility And Account Registration

You must be at least 18 years old to create an account or use 5050 Studio. By registering or using 5050 Studio, you confirm that you are 18 years of age or older.

You must provide accurate registration information and keep it up to date. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.

The service may require email verification and may offer account security features such as two-factor authentication and passkeys. You are responsible for keeping your devices, passkeys, recovery codes, provider API keys, and account access secure.

3. Service Description

5050 Studio provides account and authentication features, prompt and workflow management, media uploads, generated media, galleries, Bring Your Own Key AI provider execution, community and public prompt features, reporting and moderation tools, usage logging, and Paddle-based billing.

The exact scope of available features may depend on your account status, subscription, technical availability, provider availability, and lawful use of the service.

4. User Content

"User Content" means content you upload, enter, create, import, save, publish, report, or generate through 5050 Studio. This includes prompts, prompt variables, workflow definitions, source URLs, tags, descriptions, uploaded images or other files, generated media, public or community prompts, reports, feedback, and related metadata.

You retain the rights you have in your User Content. You grant the operator a non-exclusive, worldwide, royalty-free right to host, store, reproduce, process, transmit, transform, display, publish where selected by you, moderate, secure, back up, and otherwise use User Content to the extent necessary to provide, maintain, protect, and enforce 5050 Studio and these Terms.

5050 Studio does not use User Content to train AI models operated by 5050 Studio.

You represent that you have all rights, permissions, consents, releases, and licenses required for the User Content you submit and for your use of generated outputs.

5. Community Prompts, Reports, And Moderation

If you publish prompts or related content to public or community areas, that content and associated metadata may be visible to other users and visitors according to the feature design.

The operator may review, moderate, restrict, hide, remove, or disable access to public or community content and accounts where necessary to enforce these Terms, provider policies, payment-provider policies, legal requirements, intellectual-property rights, user safety, or service integrity.

Users may report content or conduct that appears unlawful, infringing, abusive, unsafe, or otherwise contrary to these Terms. Reports may be reviewed manually or with technical assistance. The operator may retain report metadata, moderation decisions, and relevant content snapshots where necessary for enforcement, dispute handling, or legal obligations.

6. AI Providers And Bring Your Own Key

5050 Studio may allow you to connect your own API keys for third-party AI providers, including fal.ai, Replicate, kie.ai, WaveSpeedAI, and other providers configured in the product. When you run workflows or provider-powered features, prompts, uploaded media, generated media, source URLs, workflow settings, and related metadata may be transmitted to the selected provider for processing.

Third-party AI providers are independent services. Their own terms, privacy policies, data processing rules, usage restrictions, pricing, retention practices, and content policies apply. You are responsible for reviewing and complying with those provider terms, especially where you use your own API keys.

Provider terms and policies may include, where available, fal.ai's Terms of Service, API Services terms, and Acceptable Use Policy; Replicate's Terms of Service, Acceptable Use Policy, and data retention documentation; kie.ai's available provider policies; and WaveSpeedAI's Terms of Service and Privacy Policy.

The operator does not control third-party AI providers' infrastructure, model behavior, retention practices, availability, or output quality.

7. AI Outputs

AI outputs can be inaccurate, unexpected, offensive, non-unique, or similar to outputs generated for other users. The operator does not warrant or guarantee the originality, copyright status, legal usability, suitability, accuracy, or commercial fitness of AI outputs.

You are responsible for reviewing outputs before publishing, selling, distributing, or otherwise using them. You are responsible for determining whether your use requires consent, licenses, model releases, attribution, labeling, or other legal measures.

8. Service License, Platform Rights, And Feedback

Subject to these Terms, the operator grants you a limited, non-exclusive, non-transferable, revocable right to access and use 5050 Studio for lawful purposes.

The software, interface, service design, branding, documentation, templates, examples, and other materials provided by the operator remain owned by the operator or its licensors. No rights are granted except as expressly stated in these Terms.

If you submit ideas, suggestions, or feedback, the operator may use them to improve 5050 Studio without restriction, obligation, or compensation.

9. Prohibited Use

You must not use 5050 Studio to create, upload, publish, process, or distribute content or workflows that:

  • Violate applicable law or third-party rights.
  • Infringe copyright, trademark, privacy, publicity, trade secret, database, contractual, or other rights.
  • Contain or solicit sexual, pornographic, nude, fetish, or otherwise NSFW content.
  • Involve minors in sexual, exploitative, violent, or otherwise harmful contexts.
  • Create or facilitate non-consensual intimate content, deepfakes, impersonation, identity misuse, doxxing, stalking, harassment, or unlawful biometric identification.
  • Promote hatred, violence, extremism, self-harm, fraud, malware, phishing, spam, or evasion of security controls.
  • Violate the acceptable-use policies of AI providers, Paddle, hosting providers, or other processors used by the service.
  • Attempt to overload, scrape, probe, reverse engineer, bypass access controls, or interfere with the service.

The operator may suspend or terminate accounts, remove content, block workflows, or restrict features where required for legal compliance, user safety, provider-policy compliance, payment-provider compliance, abuse prevention, security, non-payment, or enforcement of these Terms.

10. Media Uploads And Storage

Uploaded and generated media are stored in private Cloudflare R2 object storage using the European Union jurisdictional restriction.

Media may be processed into thumbnails, previews, and technical derivatives for gallery, workflow, moderation, and delivery features. Access to private media is mediated through application authorization unless content is intentionally made public by a supported feature.

11. Billing, Trials, Subscriptions, Cancellations, And Refunds

Paid transactions are processed through Paddle, which acts as Merchant of Record / authorized reseller for 5050 Studio purchases. Paddle may handle checkout, payment processing, taxes, invoices, subscription management, cancellation flows, refund handling, and buyer support according to Paddle's applicable Buyer Terms, Refund Policy, Privacy Policy, and related legal terms.

5050 Studio offers a 7-day free trial without collecting a payment method. A subscription only becomes chargeable when a user affirmatively starts a paid plan through Paddle checkout or another disclosed billing flow.

Subscriptions may be cancelled at any time. Unless otherwise required by mandatory law or Paddle's applicable buyer terms, cancellation takes effect at the end of the current billing period and prevents renewal charges.

Monthly subscription fees are generally non-refundable except where mandatory law, Paddle's applicable terms, or a material service defect requires otherwise.

For annual subscriptions, the operator's commercial policy is to allow a pro-rata refund for unused full months after an approved cancellation. For example, if seven months of an annual term have been used and a refund is approved, the remaining five unused months may be refunded. Any refund is subject to Paddle's refund handling, statutory consumer rights, fraud and abuse checks, and the checkout terms accepted at purchase.

EU/EEA consumers may have statutory withdrawal rights for certain digital service contracts. Mandatory consumer rights remain unaffected.

12. Availability And Changes

5050 Studio includes provider-dependent features. The service may be modified, interrupted, restricted, or discontinued in whole or in part. No uptime, compatibility, provider availability, model availability, or output availability is guaranteed unless expressly agreed in writing.

13. Account Deletion And Termination

You may stop using the service and may request or perform account deletion where available. Account deletion removes or anonymizes account-related data where technically and legally possible, subject to legal retention duties, billing and tax records, security logs, backups, dispute records, and processor limitations.

For expired, unconverted trial accounts, uploaded and generated creations and media are scheduled for deletion after a 7-day grace period after trial expiry, based on the current trial lifecycle cleanup configuration. Other retention periods may apply as described in the Privacy Policy.

The operator may suspend or terminate access if you violate these Terms, create security or legal risk, fail to pay, abuse the service, violate provider or payment policies, or if continued service provision is not reasonably possible.

14. Liability

Nothing in these Terms limits liability where limitation is not permitted under German law, including liability for intent, gross negligence, injury to life, body, or health, product liability, fraudulently concealed defects, guarantees expressly assumed by the operator, or mandatory statutory rights.

In cases of simple negligence, the operator is liable only for breach of essential contractual obligations. Essential contractual obligations are obligations whose fulfilment enables proper performance of the contract and on whose compliance users may regularly rely. In such cases, liability is limited to the typical, foreseeable damage, unless unlimited liability applies under the preceding paragraph.

Any liability for loss of profit, indirect damage, consequential damage, loss of data, or unavailable third-party provider services is excluded to the extent permitted by law. Statutory consumer rights remain unaffected.

15. Governing Law

German law applies, excluding conflict-of-law rules where legally permissible. Mandatory consumer protection laws of your country of residence remain unaffected where applicable.

16. Severability, Waiver, And Entire Agreement

If any provision of these Terms is invalid or unenforceable, the remaining provisions remain effective to the extent permitted by law.

Failure to enforce a provision does not waive the right to enforce it later.

These Terms, together with the referenced legal pages and checkout terms where applicable, form the agreement governing your use of 5050 Studio.

17. Changes To These Terms

The operator may update these Terms to reflect legal, technical, business, or product changes. Material changes will be communicated in a reasonable way. Continued use after changes become effective may require renewed acceptance.
